Cookies

Cookies aren't all bad. True, some will rot your teeth and others are used by popular websites to learn as much about you as possible so that they can sell it on to the highest bidder (Really. That's not just paranoia.)

45RPM Software isn't like that though. We're little, and we care about all of our customers (seriously - we don't have that many, and we can't afford to be careless and take you for granted.) So read about our cookies here.

Privacy

45RPM Software applications record and store no data about you - if you take part in a 45RPM beta software testing then you will need to report any problems to us using the email address support@45rpmsoftware.com. If you opt to send crash data to developers (and I hope that you do), this data is anonymised by Apple before being passed on. So read more about our privacy statement here.

Licenses

45RPM Software products are licensed under several terms.

Apple App Stores

Applications which are distributed on the Mac or iOS App Stores are covered by Apple's license terms. You can read the current terms of under which software distributed by this method is licensed here.

Software Distributed outside the Apple App Stores

Applications which are distributed on this website, or mirrored on other websites, are covered by the standard 45RPM Software End User License Agreement (EULA). Please be sure to check for a specific application license in the documentation for the application that you wish to use - where present this will contain extensions covering additional libraries which are included in the executable, and therefore these terms supersede this standard license. The standard EULA reads as follows:

This licence applies to all versions of 45RPM Software products other than those purchased from the Mac App Store.

Redistribution and use in binary form, without modification, is permitted provided that the following conditions are met:

THIS SOFTWARE IS PROVIDED BY PASCAL HARRIS “AS IS” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL PASCAL HARRIS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Software Distributed as Source Code

Applications or libraries which are distributed as source-code are covered by the DBAD License. The latest version of the DBAD license is available here and reads as follows:

# DON'T BE A DICK PUBLIC LICENSE

> Version 1.1, December 2016

> Copyright (C) Pascal Harris

Everyone is permitted to copy and distribute verbatim or modified copies of this license document.

> DON'T BE A DICK PUBLIC LICENSE

> TERMS AND CONDITIONS FOR COPYING, DISTRIBUTION AND MODIFICATION

1. Do whatever you like with the original work, just don't be a dick. Being a dick includes - but is not limited to - the following instances:

1a. Outright copyright infringement - Don't just copy this and change the name.

1b. Selling the unmodified original with no work done what-so-ever, that's REALLY being a dick.

1c. Modifying the original work to contain hidden harmful content. That would make you a PROPER dick.

2. If you become rich through modifications, related works/services, or supporting the original work, share the love. Only a dick would make loads off this work and not buy the original work's creator(s) a pint.

3. Code is provided with no warranty. Using somebody else's code and bitching when it goes wrong makes you a DONKEY dick. Fix the problem yourself. A non-dick would submit the fix back.
